If you have been arrested and charged with a crime such as Possession of CDS, Assault or Theft, you may be Indicted before a Grand Jury. Indictable offense arethose crimes in which the defendant could face more than 6 months in jail, steep fines, potential loss of driving privileges and a permanent criminal record. Unfortunately, several months may go by between your initial arrest and an Indictment. You should never wait until you are Indicted before retaining an attorney. Valuable evidence may be lost, witnesses may move away, and your opportunity to have the Indictment blocked or dismissed may vanish.
It is important to note, you will never talk your way out of an arrest. Let the police officer arrest you and keep the following in mind:
- Make sure they get permission from a Judge for a warrant
- Make them get permission from a Judge to use dogs in a search
- Make them do their job
